1. Introduction & Agreement

These Terms of Service (“Terms”) govern your access to and use of all software applications, browser extensions (including Seenify), web services (including Broadmail), APIs, and websites operated by Akash (codeguyakash) (“we”, “us”, or “our”), registered under D-U-N-S® 581743244 with operations in New Delhi, India.

By accessing, installing, downloading, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use or install our software.

2. Permitted Use & Account Responsibilities

You agree to use our Services solely for lawful purposes and in adherence to these Terms, applicable platform agreements (including the Chrome Web Store Developer Policies and Google API Services User Data Policy), and local regulations.

• Account Accuracy: If an account is required, you must provide truthful, current information and maintain the security of your credentials.
• Authorized Access: You are responsible for all activities occurring under your account or API credentials.
• Software Integrity: You may not reverse engineer, decompile, duplicate, or extract the source code of our proprietary software without our prior written consent.

3. Acceptable Use & Product Policies

Our products are engineered for productive, legitimate business communication. We enforce strict behavioral standards:

• Seenify (Email Tracking): Seenify is designed to confirm message engagement for professional correspondence. You agree never to use Seenify for covert harassment, surveillance of non-consenting individuals, stalking, or invasive data harvesting.
• Broadmail (Email Campaigns): Broadmail is intended solely for permission-based, opt-in communication. Sending unsolicited bulk email (spam), utilizing purchased/scraped lists, forging sender domains, or bypassing opt-out requests is strictly prohibited and results in immediate service termination without notice.
• System Protection: You may not perform security probing, automated scrapers, denial-of-service attempts, or overload our hosting infrastructure.

4. Intellectual Property Rights

All software, source code, designs, logos, interfaces, algorithms, and documentation remain the exclusive intellectual property of Akash (codeguyakash) and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use our applications in accordance with your authorized tier.

5. Service Availability, Modifications & Updates

We continually enhance our products. We reserve the right to modify, update, temporarily pause, or discontinue features with or without notice. While we endeavor to provide high reliability, our software is provided on an “as is” and “as available” basis without warranties of uninterrupted uptime.

6. Subscriptions & Commercial Terms

When paid plans or subscription tiers become available, billing will be handled transparently through our authorized payment processor, Dodo Payments.

• Billing Cycles: Charges are processed on a recurring monthly or annual basis as selected during subscription enrollment.
• Cancellation: You may cancel renewals at any time via your billing dashboard. Access remains active through the current paid term.
• Refunds: Governed by our public Refund & Cancellation Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Akash (codeguyakash) or its founder be liable for any indirect, incidental, punitive, or consequential damages, lost profits, or data loss arising from or relating to your use of or inability to use our Services.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal proceeding arising out of these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
